This page contains two parts:

  1. Website Terms & Conditions — the rules for using our website.

  2. Privacy Policy — how we collect and handle your personal information.

Travel services you book with us are governed separately by our Travel Booking Terms & Conditions.

Part 1: Website Terms & Conditions

Welcome to Travel with the Jameses. These terms and conditions ("Terms") govern your use of our website at https://travelwiththejameses.com (the "Website"). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

These Terms cover your use of the Website itself. They are separate from our Travel Booking Terms & Conditions, which govern any travel services you book with us, and from the Privacy Policy in Part 2 below.

Cookies

Our Website uses cookies. A cookie is a small text file stored on your device that helps the Website function and helps us understand how the Website is used. Cookies cannot run programs or deliver viruses to your device.

We use two categories of cookies:

  • Essential cookies, which are necessary for the Website to operate. These are always active.

  • Optional cookies (for example, analytics and marketing cookies, or cookies set by embedded third-party content such as videos or social feeds). These are only used with your consent.

Where required by law, we display a cookie banner that lets you accept or decline optional cookies before they are set. You can change your choices at any time through the banner or your browser settings. For full details, see the Privacy Policy in Part 2.

Intellectual Property

Unless otherwise stated, Travel with the Jameses and/or its licensors own the intellectual property rights for all material on the Website, including text, images, graphics, and logos. All rights are reserved. You may view and use the Website for your own personal, non-commercial use, subject to these Terms.

You must not:

  • Copy, reproduce, duplicate, or republish material from the Website;

  • Sell, rent, or sub-license material from the Website; or

  • Redistribute content from the Website, except with our prior written permission or as expressly permitted by law.

External Links to Our Website

You may link to our home page or public pages provided the link (a) is not deceptive; (b) does not falsely imply sponsorship, endorsement, or approval by us; and (c) fits within the context of your site. You may not use our logo or other artwork to link to the Website without a written trademark license from us.

We reserve the right to ask you to remove any link to our Website at any time, and you agree to remove it promptly on request.

Content Liability

We are not responsible for content that appears on any third-party website that links to us. You agree to protect and defend us against any claims arising on your website. No link to our Website should appear on any site that contains material that is libelous, obscene, or unlawful, or that infringes or advocates the infringement of any third-party rights.

No Warranty / Accuracy of Information

We do not warrant that the information on this Website is complete, accurate, or current, and we do not promise that the Website will always be available or up to date. Content on the Website (including travel information, pricing, and destination details) is provided for general informational purposes and is subject to change without notice.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties, and conditions relating to the Website and your use of it. Nothing in these Terms will:

  • Limit or exclude our or your liability for death or personal injury caused by negligence;

  • Limit or exclude our or your liability for fraud or fraudulent misrepresentation; or

  • Limit or exclude any liability that cannot be limited or excluded under applicable law.

As long as the Website and its information and services are provided free of charge, we will not be liable for any loss or damage of any nature arising from your use of the Website. Liability relating to travel services you book with us is governed separately by our Travel Booking Terms & Conditions.

Changes to These Terms

We may amend these Terms at any time. Updated versions take effect when posted to the Website. Your continued use of the Website after changes are posted means you accept the revised Terms.

Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles. Nothing in this section removes any non-waivable rights you may have under the mandatory laws of your country of residence.

Part 2: Privacy Policy

Travel with the Jameses ("we," "us," or "our"), operated by Kimberly James, an independent travel advisor affiliated with Fora Travel, Inc. ("Fora"), respects your privacy. This Privacy Policy explains what personal information we collect, how we use and share it, and the rights you have. It applies to our website at https://travelwiththejameses.com and to the travel planning and booking services we provide.

Because we serve clients in the United States and in other countries where we are legally permitted to sell travel, this policy is written to address the rights of visitors and clients in different regions, including the United States, the European Economic Area (EEA), and the United Kingdom.

Information We Collect

Information you provide to us, such as when you contact us, request a quote, or book travel:

  • Identity and contact details: name, email address, phone number, mailing address.

  • Traveler details needed to book travel: date of birth, gender, passport or other government ID details, nationality, and similar information — including for other travelers in your party that you provide to us.

  • Travel preferences: destinations, dates, budget, dietary needs, accessibility requirements, loyalty program numbers, and special requests.

  • Payment information: this is generally collected and processed by our suppliers or by Fora's payment systems; we do not store full card numbers on our own systems.

  • Any other information you choose to share with us.

Information we collect automatically when you use the Website:

  • Device and usage data: IP address, browser type, pages viewed, and how you interact with the site.

  • Cookies and similar technologies (see "Cookies" in Part 1).

Information from third parties, such as travel suppliers, Fora, or partners who help us fulfill and manage your bookings.

How We Use Your Information

We use your information to:

  • Respond to your inquiries and prepare travel quotes and itineraries;

  • Book, manage, and service your travel arrangements with suppliers;

  • Process payments through suppliers or Fora;

  • Communicate with you about your trips and, where permitted, send you travel offers and updates (you can opt out of marketing at any time);

  • Operate, secure, and improve our Website; and

  • Comply with legal obligations and enforce our terms.

Legal Bases for Processing (EEA/UK Visitors)

Where the EU or UK GDPR applies, we rely on the following legal bases: performance of a contract (to plan and book your travel); your consent (for marketing and optional cookies, which you may withdraw at any time); our legitimate interests (to operate and improve our business and Website); and compliance with legal obligations.

Cookies

We use essential cookies to run the Website and, with your consent where required, optional cookies for analytics and marketing. You can accept or decline optional cookies through our cookie banner or your browser settings. Our Website may also include third-party tools that set their own cookies — for example: [list the tools you actually use, e.g., Google Analytics, Meta Pixel, embedded video or social feeds; delete any you don't use].

How We Share Your Information

We share personal information only as needed to provide our services and run our business:

  • Travel suppliers (airlines, cruise lines, hotels, resorts, tour operators, insurers) to fulfill your bookings;

  • Fora Travel, Inc., our host agency, which supports booking, payment processing, and back-office functions;

  • Service providers that help us operate, such as our website host, email and marketing platforms, and analytics providers [name them];

  • Legal and safety recipients, where required by law or to protect rights, property, or safety.

We do not sell your personal information for money. We do not share your information for cross-context behavioral advertising except through any optional advertising cookies you have consented to.

International Data Transfers

Because travel is global, your information may be transferred to and processed in countries other than your own, including the United States, which may have different data-protection laws. Where required, we take steps to ensure appropriate safeguards are in place for such transfers.

Data Retention

We keep your information only as long as needed to provide our services, maintain business and financial records, resolve disputes, and comply with legal obligations, after which we delete or anonymize it.

Security

We use reasonable administrative and technical measures to protect your information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your Privacy Rights

Depending on where you live, you may have some or all of the following rights regarding your personal information:

  • Access a copy of the information we hold about you;

  • Correct inaccurate or incomplete information;

  • Delete your information;

  • Restrict or object to certain processing;

  • Data portability;

  • Withdraw consent at any time (for example, unsubscribe from marketing); and

  • Opt out of the sale or sharing of personal information (note: we do not sell your information).

EEA/UK residents also have the right to lodge a complaint with their local data-protection authority.

California residents have rights under the CCPA/CPRA, including the right to know, delete, and correct personal information, and to opt out of sale/sharing (we do not sell personal information), and the right not to be discriminated against for exercising these rights.

To exercise any of these rights, contact us using the details below. We may need to verify your identity before responding.

Children's Privacy

Our Website and services are directed to adults. We do not knowingly collect personal information directly from children. Where a booking includes minors, that information is provided to us by the adult making the booking, who is responsible for having the authority to share it.

Third-Party Links

Our Website may link to third-party websites (such as suppliers or partners). We are not responsible for the privacy practices of those sites, and we encourage you to review their policies.

Changes to This Policy

We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page shows when it was last revised, and material changes will be posted on this page.
